Under the conditions hereby contained, it is agreed that the
licensee
A. own the CD purchased, but under the Copyright Law,
R.W.Miller & Associates, Inc. continues to own the software
recorded on it and all copies of it;
B. make only the necessary copies of any tangible
documentation or materials provided .
C. make only the necessary copies of the software for
operating and backup purposes.
D. use the software at the designated location and
insure that use follows corporate / company software policies as related to licensed software. The licensee may not
sublicense, assign or transfer the license or the
program.
R.W.Miller & Associates, Inc. does not warrant
that the functions contained in the program will meet your
requirements or that the program operation will be uninterrupted or
error free. Any errors that may occur should be first brought to the
direct attention of R.W.Miller & Associates, Inc. for
correction.
IN NO EVENT WILL
R.W.Miller &
Associates, Inc. BE LIABLE TO YOU FOR ANY
DAMAGES, INCLUDING LOST PROFITS, LOST SAVINGS, LOSS OF DATA, COSTS
OF RECREATING LOST DATA, OR OTHER INCIDENTAL OR CONSEQUENTIAL
DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE SUCH PROGRAM EVEN
IF R.W.Miller & Associates, Inc. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR
ANY CLAIM BY ANY OTHER PARTY.
YOU MAY NOT USE, COPY, LEND, MODIFY OR TRANSFER THE
PROGRAM, OR ANY COPY, MODIFICATION OR MERGED PORTION, IN WHOLE OR IN
PART, WITHOUT THE WRITTEN PERMISSION OF
R.W.Miller & Associates, Inc. EXCEPT
AS EXPRESSLY PROVIDED FOR IN THIS LICENSE. UNAUTHORIZED TRANSFER OF
ANY COPY IS A SERIOUS VIOLATION OF FEDERAL LAW AND MAY SUBJECT A
CUSTOMER TO DAMAGES, ATTORNEY FEES AND INJUNCTIVE RELIEF. |
